Die zahlreichen Proteste der Syrer\\*innen auf den Straßen von Damaskus und anderen Städten konnten die Regierung bislang nicht davon überzeugen, die Energiepreise zu senken oder die Subventionen für Brot wieder einzuführen.\n\nDamaskus ist heute eine Stadt der krassen Gegensätze: In den wohlhabenden Vierteln reihen sich gehobene Restaurants aneinander, Luxusautos schieben sich durch den Verkehr. Nur wenige Straßen weiter kämpfen Bettler\\*innen, Kinder, ältere Menschen und Kriegsverletzte ums tägliche Überleben. Während eine Übernachtung in einem Vier-Sterne-Hotel das Dreifache des Monatsgehalts eines dort beschäftigten Angestellten kosten kann, entsprechen die Preise für Immobilien sowie für Fleisch und Konserven inzwischen weitgehend denen in Berlin, trotz eines Einkommensniveaus, das um ein Vielfaches niedriger ist.\n\nDie Wiederaufbaumaßnahmen in den vom Assad-Regime schwer zerstörten Vororten rund um Damaskus lassen nach wie vor auf sich warten. Da umfassendere Wiederaufbaumaßnahmen ausbleiben, sind die Bewohner auf individuelle und gemeinschaftlich getragene Initiativen angewiesen, um beschädigte Häuser zu reparieren und wieder bewohnbar zu machen. Bislang ist es vor allem der Bau von Hochhäusern und luxuriösen Wohnanlagen, der Investor\\*innen weiterhin anzieht. Von Mauern umschlossen, bieten die Anlagen Freizeitangebote zu extrem hohen Preisen. Juli 2026 erstmals die neue „Volksversammlung“ zusammen. Als Syriens Parlament soll sie eine neue Verfassung ausarbeiten, Gesetze verabschieden, den Staatshaushalt beschließen und die Regierung kontrollieren – so zumindest auf dem Papier. Die Erfahrungen der vergangenen anderthalb Jahre lassen jedoch Zweifel daran aufkommen, dass sie diese Aufgaben tatsächlich unabhängig wahrnehmen kann. Nachdem Meinungsverschiedenheiten zwischen einigen ihrer Mitglieder und der Exekutive über die Verfahren zur Wahl ihrer Führung beigelegt worden waren, wählte die Volksversammlung in ihrer ersten Sitzung einen Präsidenten, zwei Vizepräsident\\*innen (darunter eine Frau) und einen Sekretär.\n\nDie Volksversammlung trat zusammen, nachdem Präsident Ahmed al-Sharaa die 70 Mitglieder bekannt gab, die er direkt ernannt hatte. Gemäß der Verfassungserklärung übt der Präsident weitreichende Befugnisse über die Bildung der Volksversammlung im Rahmen eines zweistufigen Verfahrens aus: erstens die Auswahl der Mitglieder des Hohen Ausschusses, der für die Überwachung der Auswahl von zwei Dritteln der Abgeordneten der Volksversammlung im Rahmen eines begrenzten, quasi-wahlähnlichen Verfahrens zuständig ist; und zweitens die direkte Ernennung des verbleibenden Drittels.\n\nMit der Verfassungserklärung wurde zudem ein präsidiales Regierungssystem eingeführt, wodurch das Amt des Ministerpräsidenten abgeschafft und die gesamte Exekutivgewalt sowie alle Exekutivfunktionen dem Präsidenten der Republik übertragen wurden. Was die Justiz betrifft, so blieb die Struktur des Obersten Justizrats gegenüber dem System der Assad-Ära unverändert. In diesem Rahmen führt der Präsident der Republik weiterhin den Vorsitz im Obersten Justizrat, wobei der Justizminister als stellvertretender Vorsitzender fungiert, während alle anderen Mitglieder von der Exekutive ernannt werden. Dem Präsidenten wurde zudem die Befugnis übertragen, alle Mitglieder des Obersten Verfassungsgerichts zu ernennen, dessen Rolle sich darauf beschränkte, auf Ersuchen des Präsidenten beratende Stellungnahmen abzugeben.\n\n**Zusammenfassend lässt sich sagen, dass Syrien derzeit über eine einzige zentralisierte Autorität verfügt, die durch die Exekutive unter Präsident Ahmed al-Sharaa repräsentiert wird, während andere Institutionen – darunter die Volksversammlung, die Justiz und das Verfassungsgericht – ihre Befugnisse von dieser ableiten. Gleichzeitig verfügen die Legislative und die Judikative nicht über wirksame Befugnisse, um die Exekutive zu überwachen, zur Rechenschaft zu ziehen oder zu kontrollieren.**\n\nVor diesem Hintergrund hat die neue politische Entwicklung die Spaltungen innerhalb der syrischen Gesellschaft weiter verschärft, zumal die Einschränkungen politischer Aktivitäten und der Gründung politischer Parteien fortbestehen. Einige finden diese Maßnahmen notwendig, um die Übergangsphase des Landes zu bewältigen und die damit verbundenen politischen und wirtschaftlichen Herausforderungen zu meistern. Kritiker\\*innen erheben jedoch heftigen Einspruch, da sie der Ansicht sind, dass die Versammlung lediglich als Sündenbock für künftige Misserfolge dienen wird, während ihr die Befugnisse fehlen, um sinnvolle Reformen herbeizuführen.\n\nDie wichtigsten Einwände gegen das Auswahlverfahren der Versammlungsmitglieder lassen sich in drei Kernpunkten zusammenfassen:\n\n**1. Mangelnde Transparenz**\n\nDem Auswahlverfahren fehlten klare und transparente Kriterien, was Bedenken aufkommen ließ, ob die Versammlung über das erforderliche Fachwissen verfügt, um Syriens künftigen verfassungsrechtlichen und rechtlichen Rahmen zu entwerfen.\n\n**2. My heart still races whenever I pass through that same place every day.\n\nIncidents as these highlight a broader reality: since the fall of the Assad regime, the new Syrian authorities have achieved notable and rapid progress in the field of foreign policy. However, these achievements have yet been to translate into tangible improvements in the lives of ordinary citizens domestically. As Syria’s new parliament, it is expected to draft a new constitution, pass legislation, approve the state budget, and exercise oversight over the government – at least in theory. In practice, however, the experience of the past year and a half suggest that these powers remain largely nominal. During its first session, the Assembly elected a Speaker, two Deputy Speakers (including one woman), and a Secretary after resolving disagreements between some of its members and the executive authority over the procedures for electing its leadership.\n\nThe Assembly convened after President Ahmed al-Sharaa announced the 70 members he had directly appointed to complete its composition. Under the Constitutional Declaration, the President exercises broad authority over the People's Assembly’s formation through a two-stage process: first, the selection of the members of the High Committee responsible for overseeing the selection of two-thirds of the Assembly’s members through a limited quasi-electoral process; and second, the direct appointment of the remaining one-third.\n\nThe Constitutional Declaration also adopted a presidential system of governance, eliminating the position of Prime Minister and assigning all executive powers and functions to the President of the Republic. As for the judiciary, the structure of the Supreme Judicial Council remained unchanged from the Assad-era system. Under this framework, the President of the Republic continues to chair the Supreme Judicial Council, with the Minister of Justice serving as deputy chair, while all other members are appointed by the executive authority. The President was also granted the power to appoint all members of the Supreme Constitutional Court, whose role was limited to providing advisory opinions upon the request of the President.\n\n**In summary, Syria currently has a single centralized authority represented by the executive branch under the President Ahmed al-Sharaa, with other institutions – including the People's Assembly, the judiciary, and the Constitutional Court – deriving their authority from it. At the same time, the legislative and judicial branches lack effective powers to oversee, hold accountable, or check the executive authority.**\n\nAgainst this backdrop, each new political development has further polarized the divisions among Syrian society, especially as restrictions on political activity and the formation of political parties continue. Supporters argue that the Assembly will operate independently, exercise its full mandate, and effectively fulfil its responsibilities. Critics, however, strongly object, believing that the Assembly will merely function as a scapegoat for future failures while lacking the authority to bring about meaningful reform.\n\nThe main objections to the process of selecting the Assembly members can be summarized in three key points:\n\n1\\. Lack of transparency\n\nThe selection process lacked clear and transparent criteria, raising concerns about whether the Assembly includes the expertise needed to draft Syria’s future constitutional and legal framework. This expertise should cover areas such as constitutional law, legislation and legal drafting, education and scientific research, strategic planning, trade unions, civil society, and other technical fields.\n\n2\\. Insufficient representation of women\n\nWomen make up only 21 of the 210 Assembly members (around 10%), despite earlier assurances that gender representation would be improved. The outcome was widely criticised by women’s rights advocates, who viewed it as a sign of continued political marginalisation. On 2 July, the Aleppo Women Activists’ Gathering organized a peaceful protest in Aleppo University Square to express their strong opposition to the exclusion of women in the appointments to the People's Assembly.\n\n3\\. Conflicts of interest\n\nSeven members of the High Elections Committee were included in the President’s list of appointees to the People's Assembly, raising concerns regarding compliance with standards of independence and impartiality.\n\nSyria remains in the midst of a defining moment in its history.
